The claimant was neither in attendance nor represented.
The respondent was represented by Mr Peter Bloch of EEF Northern Ireland.
1. The claimant brought claims alleging unfair dismissal; failure to pay notice pay; and failure to pay statutory sick pay (breach of contract).
2. The respondent denied the claimant’s claims in their entirety. At a Case Management Discussion on 19 September 2019 Employment Judge Gamble fixed the hearing of this claim for 10 and 11 December 2019.
3. On 10 December 2019 the claimant was not in attendance. She had not sought to have the matter adjourned nor had she provided any information that she wished to have the tribunal consider nor contacted the tribunal in any way about the hearing.
4. The tribunal was satisfied that the claimant had been notified of the hearing date.
5. The tribunal heard evidence from Ms Roisin Thompson on behalf of the respondent.
6. On the basis of the evidence before it, the tribunal was not persuaded that the claimant had been unfairly dismissed or automatically unfairly dismissed or was entitled to be paid notice pay or statutory sick pay or had suffered a breach of contract. Accordingly, the tribunal dismissed the claimant’s claims in their entirety.
7. An oral decision was given on 10 December 2019 during which the tribunal gave the reasons for its decision.
