The claimant was represented by Mr Paul Dale of NIPSA.
The respondents were represented by Ms Leona Gillan, of counsel, instructed by the Departmental Solicitor’s Office.
1. The claimant brought a claim for unspecified discrimination in which she alleged that there was a financial loss as a result.
2. The respondents disputed the claimant’s claims.
3. At a Case Management Discussion on 11 April 2019 the Vice-President directed that a Pre-Hearing Review would convene to consider the following Pre-Hearing Review issues:-
(1) whether the claim form contains any claim within the statutory jurisdiction of the tribunal?
(2) if so, whether any such claim is within the statutory time-limits provided by the relevant legislation?
(3) if any such claim is outside the relevant statutory time-limit, whether the relevant statutory time-limit should be extended?
4. In relation to Pre-Hearing Review Issue 1, the tribunal found that the claim form did contain a claim within its statutory jurisdiction, a claim of unlawful deduction from wages.
5. In relation to Pre-Hearing Review Issue 2, the tribunal found that the claim was not brought within the statutory time-limit provided by the relevant legislation.
6. In relation to Pre-Hearing Review Issue 3, the tribunal refused to extend time as it concluded that the claimant had not demonstrated that it was not reasonably practicable to bring a claim within three months.
7. Accordingly, the tribunal dismissed the claimant’s claims in their entirety.
8. The reasons were given for my decision at the hearing.
