THE INDUSTRIAL TRIBUNALS
CASE REF: 4263/17
CLAIMANT: Fabian Ariel Wolf
RESPONDENT: Ruth Chocron
DECISION
The claimant's case is dismissed for want of prosecution.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge Browne
Appearances:
The claimant did not attend and was not represented.
The respondent attended and represented herself.
ISSUES
1. The claimant's case was, in terms, for payment of £380 he alleged was owed to him by the respondent for work carried out by him. The respondent's case, in terms, was that the claimant was never employed by her, and that, if he was, she did not owe him any such money.
2. The case was listed for hearing under regulation 26 of The Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005 ("the 2005 Regulations") on 31 January 2018. I am satisfied that the claimant by letter of 5 January 2018 was sent notification of the date for hearing. I am further satisfied that none of the correspondence sent to him was returned as undelivered.
3. The claimant did not attend the hearing of the case; he was not represented; nor did he or anyone on his behalf contact the tribunal requesting an adjournment, or at all.
4. In accordance with regulation 27 (6) of the 2005 Regulations, I have considered all the information in the possession of the tribunal. In all the circumstances of this case, I consider that the appropriate course is to dismiss the proceedings, in accordance with regulation 27 (5) of the 2005 Regulations, and I so order.
