THE INDUSTRIAL TRIBUNALS
CASE REF: 4185/18
CLAIMANT: Jamie Smyth
RESPONDENTS: 1. John Porter
2. JP Joinery
3. Creative Joinery Worx Limited
4. Creative Joinery Corporate Limited
DECISION
The decision of the Employment Judge sitting alone is that the claimant's claims for Breach of Contract (Holiday Pay) and failure to pay wages - Unauthorised Deduction from wages are dismissed.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge Knight
Appearances:
The claimant nor respondent appeared and neither was represented.
Reasons
1. Written notification was sent to both the claimant and respondents on 31 May 2018, by the Tribunal Office, stating that the Hearing was to take place at 10am on 6 July 2018. Neither party appeared at the appointed time nor did either party contact the tribunal office to give an explanation for their non-appearance.
2. After first considering all of the relevant documentation in this matter, I decided to dismiss the proceedings in accordance with the powers conferred on me by Rule 27 (5) of Schedule 1 of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005 as there was insufficient evidence to support the claimant's claims.
