THE INDUSTRIAL TRIBUNALS
CASE REF: 1995/17
CLAIMANT: Richard Quigley
RESPONDENT: Alan Castle
DECISION
The decision of the tribunal is that the respondent is ordered to pay to the claimant holiday pay of £122.60 and it is declared that the respondent failed to provide itemised pay statements on five weeks as set out below.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge Greene
Appearances:
The claimant appeared in person.
The respondent was neither in attendance nor represented, though he had been informed of today's hearing.
1. The claimant brought claims for breach of contract (holiday pay), failure to pay wages - unauthorised deductions from wages and right to receive an itemised pay statement.
2. The respondent did not enter a response.
3. On 21 June 2017 I made a default judgement in relation to liability as regards the above claims.
4. The claim came on for decision on remedy on today, 3 August 2017. The claimant gave evidence in relation to his claims.
5. On the basis of the evidence presented to the tribunal, I am satisfied that the respondent owes to the claimant holiday pay amounting to £122.60 and I order the respondent to make that payment.
6. I am satisfied that the claim for unlawful deduction from wages relates to the claim for holiday pay only.
7. I am further satisfied that the respondent did not provide to the claimant itemised pay statements for the weeks 12 February 2017, 19 February 2017, 5 March 2017, 19 March 2017 and 26 March 2017 and I so declare.
8. I did not make any order in relation to payment by the respondent to the claimant for unnotified deductions from wages during those weeks for which pay statements were not provided as the claimant was not able to provide details of whether any such deductions had been made and, if made, what was their amount.
9. Full reasons were given for my decision at the tribunal.
10. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
