THE INDUSTRIAL TRIBUNALS
CASE REF: 1751/16
CLAIMANT: Mary Maria Black
RESPONDENT: Anne Galway
t/a Pat's Newsagents
DECISION
The claimant's redundancy pay claim against the respondent is well founded and it is declared that the respondent is liable to make a redundancy payment of £2,592 to the claimant.
Constitution of Tribunal:
President: Eileen McBride CBE (sitting alone)
Appearances:
The claimant was self represented.
The respondent did not attend but sent a written submission to the tribunal on 13 April 2017 in which she did not dispute the claimant's claim.
Reasons
1. The claimant had been unsure as to whether she had commenced employment in 2005 or 2006. By correspondence dated 10 April 2017, Falconer Stewart, who provided payroll services to the respondent, confirmed that the claimant commenced employment with the respondent on 24 October 2005. The tribunal is therefore satisfied that the claimant worked continuously for the respondent from 24 October 2005 until 8 July 2016 (as confirmed by Falconer Stewart) when she was dismissed as the respondent ceased trading.
2. The tribunal is satisfied that the claimant's gross weekly wage was £288, that she had completed 10 full years of service by the date of her dismissal and that she was 30 years of age by that date. The multiplier for redundancy pay is therefore 9. It is therefore declared that the respondent is liable to make a redundancy payment of £2,592 (£288 x 9) to the claimant.
3. This is a relevant decision for the purposes of the Industrial Tribunal (Interest) Order (Northern Ireland) 1990.
