THE INDUSTRIAL TRIBUNALS
CASE REF: 2610/15
CLAIMANT: Lydia Pepper
RESPONDENT: Department for Employment and Learning
DECISION
The claimant’s appeal under Article 233 of the Employment Rights (Northern Ireland) Order 1996 is dismissed.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge Buggy
Appearances:
The claimant was self-represented.
The respondent was represented by Mr N Cruikshanks.
REASONS
1. By the time of this hearing, the only issue in dispute between the claimant and the respondent Department was the question of whether she was entitled to holiday pay.
2. I announced my decision at the end of the hearing. At the same time, I announced my reasons for that decision.
3. Unfortunately, the claimant is not entitled to receive a payment in respect of holiday pay from the Department, because her employment terminated in May 2014 and her employer only became bankrupt in June 2015.
