DECISION
(A) I am satisfied that Aligreen Recycling Ltd is liable to make a redundancy payment of £1,995 to the claimant.
(B) The claimant's appeals under Article 233 of the Employment Rights Order 1996 are well-founded and, in that context, I make the following declarations.
(C) The respondent Department ("the Department") ought to make a payment of £2,128 to the claimant in respect of wages
(D) The respondent Department ought to make a payment to the claimant in respect of holiday pay. The precise amount of that holiday pay payment will be determined during the course of a remedies hearing, if the parties ask for such a hearing to be held.
(E) The Department ought to make a payment of £836 to the claimant in respect of notice pay.

1. This hearing had originally been scheduled only for the purpose of addressing case management issues. However, with the agreement of the parties, a main hearing, under rule 26 of the Industrial Tribunals Rules, was held at the end of that CMD.
2. At the end of that main hearing, I announced my decision (as set out above). At the same time, I announced my reasons for that decision.
3. During the course of the hearing, the claimant and his wife provided sworn testimony. I considered both of those witnesses to be honest witnesses.
4. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
