THE INDUSTRIAL TRIBUNALS
CASE REF: 737/16
CLAIMANT: Deirdre Lenny
RESPONDENT: 1. Tara Gibney (a bankrupt)
2. Tic Toc's Daycare Ltd (in administration)
DECISION
The claimant's redundancy pay claim against the second-named respondent is well-founded and it is declared that the second-named respondent is liable to make a redundancy payment of £2,340 to the claimant.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge McCaffrey
Appearances:
The claimant did not appear and had provided written representations.
The respondents were represented by Mr L. McEvoy, the second-named respondent's accountant and administrator.
REASONS
1. The claimant had sent submissions as she was unable to attend the hearing. Her claim was for redundancy pay.
2. Mr McEvoy attended on behalf of the respondents. He advised that he was the accountant and administrator for Tic Toc Daycare Ltd, which was in administration. He confirmed his consent to the name of the respondent being amended to Tic Toc Daycare Ltd (in administration) as he indicated it had taken over ownership of the business from the first-named respondent in 2013, when she became bankrupt. I order that the name of the first-named respondent shall be amended to include the words "(a bankrupt)" and that "Tic Toc Daycare Ltd (in administration)" shall be added as the second-named respondent.
CASE REF: 737/16
3. Having considered the submissions of the claimant and Mr McEvoy on behalf of the respondent, I announced my decision at the end of the hearing. At the same time, I gave brief oral reasons for that decision.
4. This decision is based on the following information:
Gross weekly pay: £360
Net weekly pay £N/A
Number of actual completed years of service: 5
Age on date of dismissal: 44
Multiplier (for redundancy pay) 6.5
5. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
