THE INDUSTRIAL TRIBUNALS
CASE REF: 638/15
CLAIMANT: Shane Feighan
RESPONDENT: Ulster Builder Providers
DECISION ON A PRE HEARING REVIEW
The claims of alleged unfair dismissal and alleged breach of contract are dismissed for non compliance with the tribunal’s directions.
Constitution of Tribunal:
Vice President (sitting alone): Mr N Kelly
Appearances:
The claimant did not appear and was not represented.
The respondent was represented by Mr Sheehan of LJ Mallon & Co, solicitors.
1. This is a claim of alleged unfair dismissal and alleged breach of contract.
2. The case had earlier been the subject of a Case Management Discussion by telephone conference call on 8 May 2015. At that earlier Case Management Discussion the parties were directed to exchange photocopies of all documentation upon which they intended to rely on at the Hearing no later than 5.00pm on 29 May 2015 by first class post or e-mail.
3. The respondent’s solicitors had notified the tribunal by letter dated 4 June 2015 that the claimant had failed to provide photocopies of the necessary documentation in compliance with the Order of the tribunal.
4. The matter was listed for a Pre Hearing Review to determine:
“Whether the claimant’s claim should be struck out for failure to comply with the directions of the tribunal at the Case Management Discussion on 8 May 2015.”
5. I am satisfied that the claimant has failed to comply with those directions and has further failed to respond in any way to the notification of the Pre Hearing Review.
6. The claims are therefore struck out on the basis of the claimant’s non compliance with the clear directions of the tribunal.
