THE INDUSTRIAL TRIBUNALS
CASE REF: 1655/12
CLAIMANT: Colin Sloan
RESPONDENT: Raven Services Realisations Ltd (In Liquidation)
DECISION
The claimant's notice pay claim is not well-founded. Accordingly, that claim is dismissed.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment Judge Buggy
Appearances:
The claimant was not present or represented.
The respondent was not represented.
REASONS
1. The above entitled respondent used to be called Rotary Services Ltd.
2. In these proceedings, the claimant made a collective consultation complaint, pursuant to Article 216 of the Employment Rights (Northern Ireland) Order 1996.
3. That Article 216 claim was the subject of a judgment, which was issued on 27 November 2012.
4. Recently, as part of a "tidying-up" exercise, the claimant was asked to participate in Case Management Discussions in relation to this case, without success.
5. I have construed the claim form in these proceedings as including a claim for notice pay. That claim is dismissed, because I am not aware of any information or evidence that the claimant did not receive due notice of dismissal. In any event, the claimant has not proven that he has sustained any loss as a result of any lack of due notice.
