1. The claimant claimed compensation under Article 13 The Employment Relations (Northern Ireland) Order 1999 by reason of the respondent's refusal to permit her to be represented at a disciplinary hearing by a trade union official and by reason of a threat to deny her that representation at the appeal. The respondent disputed the claimant's claim in its entirety.
2. The parties dealt with this matter by way of submission on the basis of the pleadings and a statement of agreed facts.
3. Having heard the submissions from the parties and in relation to the evidence before me I am satisfied that the claimant's claim under Article 13 The Employment Relations (Northern Ireland) Order 1999 is well-founded and I order the respondent to pay to the claimant compensation in the sum of £400.00.
4. Oral reasons were given at the hearing for the tribunal's decision.
5. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
