1. The title of the respondents was amended to that now shown above.
2. The respondents entered a late response which was rejected, and they have not sought a review of that decision.
3. I am satisfied that the claimant, Ms Gallagher, is an honest witness and on the basis of her evidence, I hereby order that the respondents pay to the claimant the following sums:-
(a) a redundancy payment of £7,990.00 calculated on the basis that the claimant had 16 years’ complete service, was aged 43 at the time of her dismissal, and had a gross weekly wage of £623.00 (to which the statutory cap of £470.00 is applied).
The appropriated multiplier is 17 (17 x £470.00 = £7,990.00);
(b) a sum of £5,772.00 in respect of breach of contract
(12 weeks’ notice pay on a net weekly wage of £481.00); and
(c) a sum of £208.00 in respect of unpaid holiday pay.
5. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
