DECISION
The claimant is granted leave to amend his claim form so as to include a claim for unfair dismissal (based on the factual allegations which are already set out in the claim form).

REASONS
1. I announced my decision at the end of the hearing. At the same time I announced my reasons for that decision.
2. In summary, I granted the claimant leave to amend his claim form, so as to include a claim for unfair dismissal, for the following reasons. I was satisfied that an illness was an important reason for the delay in making an unfair dismissal claim or in seeking leave to amend. The delay was relatively short. The respondent’s ability to defend itself would not be significantly affected by a decision to allow the amendment. In granting leave, I took full account of the fact that the primary time-limit, as set out in the unfair dismissal legislation, had expired by the time the claimant first asked for leave to amend.
