THE
INDUSTRIAL TRIBUNALS
CASE REF: 1096/14
CLAIMANT: Wojciech
Wiercioch
RESPONDENT: Department
for Employment and Learning
DECISION
Pursuant to Article 233 of the
Employment Rights Order, I determine that the respondent Department (“the Department”)
ought to make the following payments to the claimant: (1) a payment of £872 in
respect of unfair dismissal and (2) a payment of £582 in respect of notice pay.
Constitution of Tribunal:
Employment Judge (sitting alone): Employment
Judge Buggy
Appearances:
The
claimant was self-represented.
The Department
was represented by Mr Neil Cruikshanks.
REASONS
1.
The Department has
had difficulty in obtaining documentary confirmation in respect of the sums
claimed by the claimant. That is not his fault, and it seems not to be the
Department’s fault. However, matters have dragged on, and the amounts at stake
are relatively small.
2.
Against that
background, the Department and the claimant, during the course of this hearing,
accepted that, on the basis of the information available to the parties, the
claimant was due the sums specified above, from the Department (in the
Department’s role as the statutory guarantor in respect of certain employment
debts).
3.
This is a relevant
decision for the purposes of the Industrial Tribunals (Interest) Order (Northern
Ireland) 1990.
