THE INDUSTRIAL TRIBUNALS
CASE REF: 1006/14
CLAIMANT: Patrick Joseph Conway
RESPONDENT: Metro Surveillance Group Ltd
DECISION
The decision of the tribunal is set out at Paragraph 3. below.
Constitution of Tribunal:
Employment Judge Buchanan (sitting alone)
Appearances:
The claimant was represented by his father, Mr John J Conway.
No response was entered on behalf of the respondent company.
1 The claimant started work with the respondent company on or around 28 January 2014 as a CCTV operator.
He remained in employment with them for around three months.
2(i) I found the claimant to be a honest witness and am satisfied from his oral evidence and the documentary evidence which he produced that during his period of employment the respondent company failed to pay his wages. Although he was provided with some wages slips, his bank statements show that none of the money was ever paid into his account.
(ii) When he queried this he was told there were ‘cash flow problems’.
(iii) The outstanding wages amount to £2,255.96.
3 I am satisfied that the respondent company is in breach of the claimant’s contract of employment and I order that it do pay to him the said sum of £2,255.96 outstanding on the termination of his employment.
4 This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
