CLAIMANT: Nicola Cunningham
RESPONDENT: Truckmark Ltd
DECISION
The decision of the tribunal is that:-
(i) the claimant is entitled to a redundancy payment of £860.00 from the respondent company calculated on the basis of the information set out at Paragraph 1. below; and
(ii) the respondent company do pay to the claimant the sum of £908.00 in respect of unpaid notice pay, £354.00 in respect of unpaid wages, and £708.00 in respect of unpaid holiday pay.
Constitution of Tribunal:
Chairman (sitting alone): Mr D Buchanan
Appearances:
The claimant appeared in person and was not represented.
The respondent company did not enter a response, and there was no appearance on its behalf.
1(i) The claimant worked for the respondent company from 1 October 2010 until 4 January 2013, when she was made redundant. She had two years’ complete service.
(ii) She was aged 30 at the time of her dismissal.
(iii) She earned £454.00 per week.
(iv) The appropriate multiplier for calculating her redundancy pay is 2.
(v) She is therefore entitled to a redundancy payment of £860.00 (2 x £430.00, the statutory cap at the relevant time).
2 I am further satisfied from her evidence that she is also entitled to the following amounts, and I order that the respondent company pay the said sums to her:-
(i) £354.00 in respect of unpaid wages;
(ii) £908.00 in respect of notice pay; and
(iii) £708.00 in respect of unpaid holiday pay
