THE INDUSTRIAL TRIBUNALS
CASE REF: 1497/13
CLAIMANT: Alan Harold Ramsey
RESPONDENT: Redundancy Payments Branch
DECISION
The tribunal was not persuaded that the claimant was an employee from 1999 until 2006 and therefore it dismisses the claims against the respondent for redundancy pay and notice pay relating to that period.
Constitution of Tribunal:
Chairman (sitting alone): Mr B Greene
Appearances:
The claimant appeared in person.
The respondent was represented by Mr Philip McAteer, of Counsel, instructed the Departmental Solicitors Office.
1. The claimant brought claims against the respondent for redundancy pay and notice pay in the amounts of £4,515.00 and approximately £2,580.00 for the period 1996 to 2006.
2. The respondent disputed the claimant’s entitlement to receive a redundancy payment or notice pay as it asserted the claimant did not satisfy the definition of an employee under the Employment Rights (Northern Ireland) Order 1996.
3. The tribunal having heard the evidence adduced on behalf of both parties concluded that it was not satisfied that the claimant was an employee from 1999 until 2006 and therefore he was not entitled to a redundancy payment and notice pay in relation to that period.
4. Oral reasons were given at the hearing for the tribunal’s decision.
