THE INDUSTRIAL TRIBUNALS
CASE REF: 1128/12
CLAIMANT: Robert Thomas McConnell
RESPONDENT: TLR Resourcing Ltd (in liquidation)
DECISION ON AN APPLICATION FOR REVIEW
The review application is successful. I have decided to revoke the strike-out Decision.
Constitution of Tribunal:
Chairman (sitting alone): Mr P Buggy
Appearances:
The claimant was represented by Ms A Douglas, Solicitor.
The respondent was not represented.
REASONS
1. Although Select Management Ltd is not a party to these proceedings, it clearly had an interest in the outcome of the strike-out application. By agreement, Mr Gerald Kelly Solicitor was present at this hearing on behalf of Select.
2. Mr Peter Curran of the Redundancy Payments Service was present also.
3. The case had been struck out by me, because I believed that the claimant had deliberately not complied with a direction which I had made (whereby he was required to provide details of his current position in relation to this litigation).
4. Having considered the representations made by Ms Douglas in the course of this hearing, and having noted that reinstatement of this case was not opposed either by Select or by Mr Curran, I decided to revoke the strike-out order. I was satisfied that it was appropriate to do so, in light of the fact that the claimant was now ready and willing to pursue this litigation.
