THE INDUSTRIAL TRIBUNALS
CASE REF: 1365/12
CLAIMANT: Daniel Lavery
RESPONDENTS: 1. Outdoor Services Limited
2. Martin Downey
DECISION
The decision of the tribunal is that the claimant is entitled to a redundancy payment in the sum of £5,130.00.
Constitution of Tribunal:
Chairman (Sitting alone): Mr S M P Cross
Appearances:
The claimant appeared in person.
The respondents did not appear and were not represented.
1. The first-named respondent was the employer of the claimant and the second-named respondent is dismissed from the case.
2. On 25 April 2012, the claimant received a letter from the respondent company informing him that his application for voluntary redundancy from the company had been accepted. This was calculated as 15 weeks pay at the claimant’s pay of £342.00 per week. The claimant was born on 16 November 1959 and was consequently 52 years old on the date of redundancy, 4 July 2012. He had 10 years completed service with the respondent.
3. Although the respondent paid the claimant other money due to him, he has never received the redundancy money. It would appear that the company is now out of business.
4. The tribunal award to the claimant a redundancy payment of £5,130.00.
5. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
