THE INDUSTRIAL TRIBUNALS
CASE REF: 147/12
CLAIMANT: Stephanie Allison Nora Meenagh
RESPONDENT: Systems Encore Ltd
DECISION
The decision of the tribunal is that the respondent company do pay to the claimant the sum of £262.50 in respect of breach of contract (notice pay) and the sum of £1,050.00 in respect of unlawful deductions from wages.
Constitution of Tribunal:
Chairman (sitting alone): Mr D Buchanan
Appearances:
The claimant, Ms Meenagh, appeared in person and was not represented.
The respondent company did not enter a response, nor was it represented at the hearing.
1. The second and third-named respondents, Roger Mawhinney and Roy Lamont, are dismissed from the proceedings. They were directors of the remaining respondent, a limited company, and the claimant accepts that it was her employer.
2(i) I order that the respondent company do pay to the claimant the sum of £262.50 in respect of breach of contract (unpaid notice pay) and the sum of £1,050.00 in respect of unlawful deductions from her wages.
(ii) I am satisfied that these sums are owing on the basis of the claimant’s uncontradicted evidence at the hearing. She also produced correspondence from the company, which conceded that notice pay and wages were outstanding, albeit it did not quantify the sums owing.
3. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
