THE INDUSTRIAL TRIBUNALS
CASE REF: 1091/11
CLAIMANT: Barry Gerard McGirr
RESPONDENT: Dromore Glass and Glazing Ltd
DECISION
The decision of the tribunal is that the claimant is awarded the sum of £8,098 in respect of redundancy pay and notice pay.
Constitution of Tribunal:
Chairman (sitting alone): Mrs Ó Murray
Appearances:
The claimant appeared in person.
The respondent did not appear and was not represented.
Reasons
1. The claimant was employed as a General Operative by the respondent from 7 September 1992 until 11 November 2010. He was therefore employed 18 years. The claimant’s gross and net earnings were £309.00 per week and £250.00 per week respectively.
2. The claimant was made redundant without notice on 11 November 2010 as the company closed with immediate effect. The claimant’s age at the date of termination was 37 years. His date of birth is 3 October 1973.
3. The redundancy pay calculation, rounded down, is as follows:
16.5 weeks x £309.00 gross = £5098.
4. The claimant is entitled to the statutory notice which is one week’s net pay for each full year worked subject to a maximum of 12 weeks’ pay. The calculation therefore is as follows:
12 weeks x £250.00 = £3,000.00
5. The total compensation payable is therefore £8098.
6. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
