THE INDUSTRIAL TRIBUNALS
CASE REF: 2803/10
APPELLANT: Brian McLoughlin T/a Carna Service St
RESPONDENT: Armagh City & District Council
DECISION
The unanimous decision of the tribunal is that the Improvement Notice dated 24 November 2010 should be amended, by consent, to provide that the appellant will remedy the named contraventions by 26 July 2011.
Constitution of Tribunal:
Chairman: Mr P Kinney
Members: Mr W Irwin
Dr D Mercer
Appearances:
The appellant appeared in person and represented himself.
The respondent was represented by Mr Donaghy, of Armagh City & District Council.
1. The respondent issued an Improvement Notice relating to the appellant’s premises at Castleblaney Road, Keady, Co Armagh. It stated that the roof and ceiling throughout the premises had not been maintained in a good condition that is safe and without risks to health and required the contraventions to be remedied by 19 January 2011. The nature of the works required were identified in the schedule to the Notice. The appellant appealed against the Improvement Notice and his appeal was received by the Office of the Tribunals on 10 December 2010.
2. At the hearing today the tribunal was informed that a Prohibition Notice has now been served over a portion of the roof that has caused concern. The parties, however, have agreed that the appellant should have an extension of time in which to complete the necessary works to the roof in accordance with the various statutory requirements.
3. The tribunal therefore, with the consent of the parties, orders that the Improvement Notice issued on 24 November 2010 be amended to provide that the contraventions identified in the Improvement Notice shall be remedied by 26 July 2011.
