The respondent is ordered to pay to the claimant £825.00 being wages which the respondent failed to pay when it ceased trade.

REASONS
1. The claimant was employed from mid-June 2011 by the respondent as a Labourer.
2. When the respondent ceased trading on 31 August 2011, the claimant had not been paid for 3 weeks work between 1 to 19 August 2011. The agreed wage was £275.00 per week.
3. Article 45 of the Employment Rights (Northern Ireland) Order 1996 provides that employees have a right not to suffer unauthorised deductions by employers. By failing to make the payments agreed, the respondent is in breach of this provision.
4. The claimant is entitled to compensation of £825.00 in respect of the unpaid wages.
This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (NI) 1990.
