THE INDUSTRIAL TRIBUNALS
CASE REF: 1977/10
CLAIMANT: Jacqueline Karim
RESPONDENT: Laura Ashley
DECISION ON REVIEW
It is the decision of the tribunal that the interest calculation in respect of injury to feelings set out in the main decision in this case issued to the parties on 20 May 2011 was incorrect in that it calculated interest on the injury to feelings element of the award from the midpoint of the injury rather than the start of the injury. Accordingly, the tribunal alters its decision to provide that the sum to be paid by the respondent to the claimant is £9,975.02.
1. Pursuant to the powers of the tribunal to review its own decision under Rule 34, paragraph (5) of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005, the tribunal is amending the interests calculation in respect of the award for injury to feelings. Accordingly, paragraph 22 of the decision is amended to provide that the commencement date of interest on the award is now 25 April 2010 rather than 1 June 2010. Consequently, the arithmetic calculation of interest in the Summary in paragraph 24 is amended as follows:-
Interest: |
£6,000.00 x 8% x 346 days (25 April 2010 to 6 April 2011) |
= £455.02 |
|
365 |
|
2. Consequently, the total of compensation is amended in the same paragraph to be £9,975.02.
