THE INDUSTRIAL TRIBUNALS
CASE REF: 1787/11
CLAIMANT: Jerome Francis McCabe
RESPONDENT: Neil Murphy
DECISION
The decision of the tribunal is that the claimant is entitled to unpaid wages in the sum of £950.00.
Constitution of Tribunal:
Chairman (sitting alone): Mr P Kinney
Appearances:
The claimant did not appear, but was represented by his mother, Roseanna McCabe.
The respondent did not appear and was not represented.
1. In arriving at my decision I have taken into account the claimant’s claim form, documentary evidence produced to me today by Mrs McCabe and evidence given under oath by Mrs McCabe. The claimant commenced employment with the respondent on 4 September 2010 and the employment terminated on 25 March 2011. The claimant had given the respondent one month’s notice. He earned £950.00 per month. The respondent did not pay the claimant for one month’s wages. He acknowledged this non-payment on several occasions, including by an e-mail to the claimant on 13 April 2011 and a further e-mail on 27 April 2011. The wages have never been paid.
2. I am satisfied that the claimant’s claim is well-founded and it is my decision that the claimant is entitled to unpaid wages in the sum of £950.00.
3. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
