RESPONDENTS: 1. Derek Brennan

DECISION ON A REVIEW
The unanimous decision of the tribunal, on a review, is set out at Paragraph 1. below.
Constitution of Tribunal:
Chairman: Mr D Buchanan
Members: Mr R Hanna
Mr J Kinnear
Appearances:
The claimant was represented by Mr C Hagan, Barrister-at-Law, instructed by Faloon & Company, Solicitors.
The respondents did not appear nor were they represented. Both had been given notice of these proceedings.
1(i) The review application was out of time. The tribunal is satisfied that it is just and equitable to extend the time for bringing a review. It extends time to the date of the hearing, 14 June 2011.
(ii) The tribunal adds Gail Brennan trading as The Madhatters, as a respondent to these proceedings. It is satisfied that she was the employer of the claimant at the relevant time. The title of the proceedings is consequently amended to that now shown.
(iii) The tribunal awards costs in the sum of £500.00, together with VAT thereon, against the respondents. It is satisfied that they have acted unreasonably in the conduct of these proceedings, making this review hearing necessary.
