THE INDUSTRIAL TRIBUNALS
CASE REF: 1602/11
CLAIMANT: David James Norris
RESPONDENT: Time Worldwide Express Limited
DECISION
The decision of the tribunal is that the claimant is entitled to a redundancy payment of £3000.00.
Constitution of Tribunal:
Chairman (sitting alone): Mr B Greene
Appearances:
The claimant appeared in person.
The respondent did not appear nor was it represented.
Reasons
1. The claimant claimed a redundancy payment and for notice pay.
2. The respondent did not enter a response but in correspondence, exhibited by the claimant, from the respondent to him it indicated that it accepted the claimant’s entitlement to notice pay and redundancy payment.
3. Since the presentation of the claim the claimant has received his notice pay and therefore is no longer pursuing that claim and accordingly that aspect of his claim is dismissed.
4. From the correspondence exhibited it appears the respondent’s proper title is Time Worldwide Express Limited and the proceedings are amended accordingly without any objection from the claimant.
5. The respondent, in a letter to the claimant of 23 June 2011, accepted that the claimant was entitled to statutory redundancy pay which it calculated at £3000.00. The claimant did not dispute that statement or the calculation nor has he received such payment in the intervening period.
6. Accordingly the claimant is entitled to a redundancy payment of £3000.00.
7. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
