THE INDUSTRIAL TRIBUNALS
CASE REF: 764/11
CLAIMANT: Mabel Bell
RESPONDENT: Larfran Industries LLP
DECISION
The unanimous decision of the tribunal is that the claimant is entitled to £3330.00 in respect of redundancy pay.
Constitution of Tribunal:
Chairman (sitting alone): Mrs F Oliver
Appearances:
The claimant appeared in person.
The respondent did not appear and was not represented.
1. The issue for the tribunal is whether the claimant is entitled to redundancy pay in respect of her employment.
2. The claimant informed the tribunal that she was employed by the respondent from April 1997 until 28 December 2010 when the respondent ceased trading. By letter dated 28 December 2010, the respondent accepted that the claimant was entitled to redundancy but indicated that it was not in a position to pay the amount due.
3. The claimant handed in two pay slips indicating that she was earning £180.00 gross per week.
4. The claimant was aged 52 at the date of termination. At that time she had been employed for 13 complete years. The claimant was earning £180.00 per week gross. The claimant is therefore entitled to a payment of £3330.00 being 11 years at 1.5 times gross pay and two years at 1 times gross pay.
5. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
