THE INDUSTRIAL TRIBUNALS
CASE REF: 322/11
CLAIMANT: Darren Patton
RESPONDENT: Derry Morgan Transport
DECISION
The unanimous decision of the tribunal is that the claimant’s claims are dismissed.
Constitution of Tribunal:
Chairman: Mr P Kinney
Members: Mr D Hampton
Mr R Hanna
Appearances:
The claimant did not appear and was not represented.
The respondent did not appear and was not represented.
1. The claimant has made claims for unauthorised deduction from wages and breach of contract. The claimant did not attend the hearing. The tribunal was satisfied that the claimant was properly notified of the hearing. The tribunal then considered the claim form. There was insufficient information on the papers to satisfy the tribunal that it was appropriate to make findings in the claimant’s favour. The tribunal did not have the benefit of hearing evidence from the claimant. As the burden of proof lies with the claimant the tribunal has determined that the claimant’s claims be dismissed.
