THE INDUSTRIAL TRIBUNALS
CASE REF: 899/03
CLAIMANT: William Spiers Black
RESPONDENT: Shorts Bros Plc
DECISION
The unanimous decision of the tribunal is that the claimant is entitled to compensation for unfair dismissal of £59,850.00, to be paid to him by the respondent.
Constitution of Tribunal:
Chairman: Mr P Cross
Members: Mr J E Martin
Dr V Eakin
Appearances:
The claimant appeared in person and was not represented.
The respondent was represented by Mr P Bloch of the Engineering Employers Federation.
1. This hearing followed a decision of this tribunal dated 5 June 2008, when the tribunal found that the claimant had been unfairly dismissed by the respondent. This tribunal then held a remedy hearing and issued a decision on 16 February 2009, awarding compensation to the claimant. The level of compensation payable was to be agreed by the parties. If the parties failed to agree the amount of compensation, then the matter was to be again listed before this tribunal.
2. Some difficulty was experienced between the parties in agreeing the amount of compensation payable and the matter has come before this tribunal.
3. However, the parties have now reached agreement on the amount of compensation to be paid by the respondent to the claimant. The parties announced to the tribunal that the sum payable should be £59,850.00. The tribunal accordingly awards this sum to be paid by the respondent to the claimant.
4. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
