1. The claimant made a claim for constructive unfair dismissal. The claimant did not appear at the hearing nor was any explanation provided for the claimant’s absence. Mr Potter confirmed that there had been no response to Notices to the claimant nor had any other attempts at contact proved successful. The tribunal considered the claimant’s claim form. There was insufficient information on the papers to satisfy the tribunal that it was appropriate to make findings in the claimant’s favour. The tribunal did not have the benefit of hearing evidence from the claimant. The tribunal has determined that the claimant’s claim be dismissed.
