CASE REF: 2033/10
CLAIMANT: Gregory George William McDaid
RESPONDENT: Adrian McDaid
DECISION
The unanimous decision of the tribunal is that the claimant’s claims for unpaid wages and holiday pay are dismissed.
Constitution of Tribunal:
Chairman (sitting alone): Ms Fionnuala Oliver
Appearances:
The claimant did not appear and was not represented.
The respondent did not appear and was not represented.
1. The issue for the tribunal is whether the claimant is entitled to two weeks pay in respect of a lying week and a week unpaid at the end of his employment and whether the claimant is entitled to holiday pay.
2. Neither party attended the hearing. The tribunal decided to dispose of the proceedings in the absence of the parties, pursuant to Regulation 27(5) of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005.
3. The tribunal considered the originating claim of the claimant. The tribunal finds that the claimant has not discharged the burden of proving on the balance of probability that he is entitled to two week’s pay or to holiday pay. Accordingly, all the claimant’s claims are dismissed.
