DECISION
The decision of the tribunal is that the tribunal hereby dismisses the proceedings under Rule 27(5) of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005, there being insufficient evidence before it to dispose of the proceedings.

1. The claimant complained in her claim that she had not received a written statement of employment particulars and that in breach of her contract of employment had not been paid holiday pay and wages.
2. No response has been accepted under the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005.
3. This case was previously adjourned from hearing on 26 June 2009 in the absence of attendance by or representation for either party due to doubt whether the Notice of Hearing had been sent to the claimant at her correct address. No formal notification has however been received from the claimant advising of a change of address. A new Notice of Hearing was sent to all parties on 10 November 2009 for the hearing on 15 December 2009.
4. In the absence of attendance by or representation on behalf of either party at the hearing on 15 December 2009 the tribunal considered the information in its possession made available by the parties. There being insufficient evidence before it to dispose of the proceedings, the tribunal hereby dismisses the proceedings.
