THE INDUSTRIAL TRIBUNALS
CASE REF: 1570/10
CLAIMANT: Pamela Robinson
RESPONDENT: Bann Leisure & Retail Limited
DECISION
The decision of the tribunal is that the claimant is entitled to £232.00 in respect of notice pay and a statutory redundancy payment of £2,976.00 and the respondent is directed to pay that sum to the claimant.
Constitution of Tribunal:
Chairman (sitting alone): Mr N Kelly
Appearances:
The claimant appeared in person.
The respondent did not enter a notice of appearance, did not appear and was not represented.
1. The claimant in her claim form stated that she had commenced employment with the respondent on 5 September 1997 and that employment was terminated without notice on 17 December 2009 on the ground of redundancy. In evidence she thought she had started in 1993 but in a written statement she said she was employed for six years.
2. The respondent wrote to the claimant on 8 April 2010 accepting liability for £1232.00 notice pay and £2976.00 redundancy pay. The claimant did not dispute those figures. The respondent paid £1000.00 in part payment.
3. The respondent therefore owes the claimant £232.00 in respect of notice pay and £2,976.00 in respect of statutory redundancy.
4. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order 1990.
