THE INDUSTRIAL TRIBUNALS
CASE REF: 1539/10
CLAIMANT: Gail Winters
RESPONDENT: Bann Leisure and Retail Limited
DECISION
The decision of the tribunal is that the claimant is entitled to a statutory redundancy payment of £592.74 calculated as set out in this decision, and the respondent is directed to pay that sum to the claimant.
Constitution of Tribunal:
Chairman (sitting alone): Mr N Kelly
Appearances:
The claimant attended in person.
The respondent did not enter a notice of appearance, did not appear and was not represented.
1. The claimant commenced employment with the respondent in August 2006 and that employment was terminated on 16 December 2009 with no notice.
2. The effective date of termination, taking into account the statutory minimum period of notice was 6 January 2010.
3. The claimant’s net weekly pay varied from week to week and the claimant had only one pay slip with her at the tribunal. However the respondent had written to the claimant on 8 April 2010 accepting liability for £592.74 redundancy pay.
4. That figure, on the information to hand, appears to be correct and the respondent is directed to pay that sum to the claimant.
5. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (NI) 1990.
