THE INDUSTRIAL TRIBUNALS
CASE REF: 1326/10
CLAIMANT: James Johnston
RESPONDENT: R Barton and Son Builders
DECISION
The decision of the tribunal is that the claimant is entitled to redundancy pay in the sum of £5,668.99.
Constitution of Tribunal:
Chairman (sitting alone): Ms Ò Murray
Appearances:
The claimant appeared and was unrepresented.
The respondent was represented by Mr Niall Barton.
Reasons
1. The respondent had filed a response form on 4 June 2010 indicating that it did not intend to defend the case and Mr Barton confirmed at hearing that this remained the position.
2. Having considered the oral and documentary evidence provided by the claimant I am satisfied that the claimant is entitled to redundancy pay in the sum of £5,668.99 calculated as follows:
Date of birth – 23 April 1964.
Age at termination of employment – 45.
Dates of employment – 8 September 1994-16 April 2010 = 15 full years.
Gross weekly wage - £333.47.
4 years x 1½ weeks x £333.47 = £2,000.82
11 years x 1 week x £333.47 = £3,668.17
TOTAL £5,668.99
