DEFAULT JUDGEMENT
The time for presenting a response having expired, I find that the claimant’s complaints in respect of an unpaid redundancy payment and in respect of breach of contract (notice pay and holiday pay) against the first named respondents (Cairde Bhunscoil Phobal Feirste) are well founded.
I am satisfied that the claimant is entitled to a redundancy payment of £5,860, to notice pay of £243 and to holiday of £243.
REASONS
I am satisfied that, when her employment with the first named respondent (Cairde) came to an end, it was terminated because of redundancy. I am satisfied that, at the relevant time, the claimant’s length of service in that employment has to be treated as having been service of approximately 24 years; that, at the relevant time, her gross pay was £293 and her net pay £243; that she was born on 12 November 1941 and that she was dismissed on 13 November 2008.
This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
