THE INDUSTRIAL TRIBUNALS
CASE REF: 1784/07
CLAIMANT: Jaroslav Rapcan
RESPONDENT: Tullyglass House Hotel
DECISION
The unanimous decision of the tribunal is that the claimant's claims be dismissed.
Constitution of Tribunal:
Chairman: Mr Davey
Members: Mr McConnell
Mr McKeown
Appearances:
The claimant appeared in person.
The respondent was represented by Mr P McCollum, of Pass International.
Reasons
- The claimant had claimed:-
(i) holiday pay, whether under contract or on foot of the Working Time Regulations;
(ii) a payment due on foot of failure to provide itemised pay statements;
(iii) a declaration as to particulars of employment;
(iv) an order requiring the respondent to provide such statements and particulars to all part-time staff and providing for monitoring of the respondent to ensure compliance.
- In evidence to the tribunal the claimant stated that all outstanding monies due to him on whatever footing has been paid to him and further that, as he had terminated his employment with the respondent, he no longer required for himself a declaration as to his particulars for employment. Accordingly the tribunal dismisses the claims referred to in Paragraph 1(i), (ii) and (iii) above.
- The claimant sought an order in the terms referred to in Paragraph 1(iv) above. The tribunal has no jurisdiction to make such an order and accordingly that claim is dismissed also.
