FAIR EMPLOYMENT TRIBUNAL
CASE REFS: 92/05 FET
662/05
CLAIMANT: Whyed Muhammed Gill
RESPONDENT: The Extern Organisation Ltd
DECISION ON A PRE-HEARING REVIEW
The decision of the Tribunal is that unless the claimant complies with an Order for Additional Information, made on 30 October 2006, and an Order for Discovery, also made on 30 October 2006, not later than 29 June 2007, the Tribunal will make a decision striking out his claims without further consideration or the need to hold a further hearing.
Constitution of Tribunal:
Chairman (sitting alone): Mr D Buchanan
Appearances:
The claimant, Mr Gill, by telephone conference facility.
The respondent was represented by Ms J Blair, Solicitor, of J Blair Employment Law Solicitor.
- The claimant presented these claims to the Tribunal on 18 April 2005.
- On 30 October 2006 an Order for Additional Information and an Order for Discovery were made against the claimant.
- These Orders have not been complied with. That remains the position. Mr Gill does not deny this. He has been unwell.
- I am satisfied that the appropriate course is now to make an 'Unless Order'. I explained that concept and the consequences of non-compliance to Mr Gill. He does not object to the making of such an Order.
- UNLESS the claimant complies with the Order for Additional Information made on 30 October 2006, and the Order for Discovery of the same date, not later than 29 July 2007, the Tribunal will make a decision striking out his claims without further consideration.
