REASONS
1. There was no appearance by either party. The tribunal considered that it would be appropriate to deal with the matter in the absence of the parties taking into account the information contained in the originating application and the response.
2. On consideration of the papers there was a clear conflict between the claimant and the respondent as to the circumstances surrounding the termination of the employment relationship which had existed between them. In the absence of testimony from the parties there was insufficient evidence for the tribunal to determine whether the claimant has been dismissed or not.
3. For a claimant to be entitled to bring a claim of this nature before the tribunal it is first necessary to establish a dismissal. As set out above the claimant has not discharged that burden and accordingly, the claim must fail.
