THE INDUSTRIAL TRIBUNALS
CASE REF: 01341/01
CLAIMANT: Mary Wasson
RESPONDENT: Dr C Wasson
DECISION
It is the unanimous decision of the tribunal that notice be sent to the parties to this case of intention on the part of the tribunal to strike out the claim of the claimant on the grounds that her claim has not been actively pursued.
Constitution of tribunal:
Chairman: Ms Crooke
Appearances:
Neither party appeared. Neither party instructed any representation.
The Claim of the Claimant
The claimant's claim was that she had suffered a detriment contrary to the Employment Rights (Northern Ireland) Order 1996 as amended by the Public Interest Disclosure (Northern Ireland) Order 1998. The respondent contended that the detriment was not caused by him.
In all the circumstances of the case, the tribunal considers that the overriding objective requires that the parties be given notice that the tribunal intends to strike out the claim of the claimant on the ground that it has not been actively pursued. Therefore if the parties have not contacted the tribunal within 28 days from the date of this decision, giving
reasons why an order striking out the claim of the claimant should not be made, then the claim of the claimant will be struck out.
