THE INDUSTRIAL TRIBUNALS
CASE REFS: 49/06
397/05
307/06
CLAIMANT: Iris Smyth
RESPONDENT: T F Woodside & Co Ltd
Constitution of Tribunal:
Vice President (sitting alone): Mrs Price
Appearances:
The claimant was represented by Mr S McGranaghan, Solicitor, of O'Reilly Stewart, Solicitors.
The respondent was represented by Ms H Crothers, of the respondent company.
DECISION ON AN APPLICATION TO REVIEW A DECISION
- The respondent had applied for a review of the Chairman's decision on 14 March 2006 that the response was outside the time limit set out in Rule 41 of Schedule 1 of the Industrial Tribunals Rules of Procedure Regulations 2005. I am satisfied under Rule 34(3)(e) that the interests of justice require such a review and I accept that the response was submitted outside the time limit due to a postal strike which was in operation at the relevant time. The decision not to accept the response is now revoked.
- The parties have agreed that the various claims made by the claimant should be consolidated for the purposes of one hearing and I so direct.
