FACTS
3. By an application dated 4th December 2005, the claimant commenced proceedings for wages, holiday pay, notice pay, and pension contributions. Two respondents with two separate addresses were named, Kestrel 3D Aerospace and Kestrel 3D Limited. No response was received from either entity and on the direction of a chairman the matter was listed for pre-hearing review on the issue of the correct respondent.
4. The claimant has not attended today and he has not made any representations in writing on the issue.
DETERMINATION
5. The matter was listed for pre-hearing review because the identity of the correct respondent was unclear from the information provided on the claim form. It is for the claimant to satisfy the tribunal as to the identity of the correct respondent. The claimant has neither attended the pre-hearing review nor provided any further information which might assist the tribunal in determining the identity of the correct respondent. In the circumstances, the claim is dismissed.
