THE INDUSTRIAL TRIBUNALS
CASE REFS: 726/02
763/02
APPLICANTS: 1. Johanna Doris
2. Celine Flanagan
RESPONDENT: Floor Store Distribution Limited
DECISION
SUMMARY REASONS
It is the unanimous decision of the Tribunal that both applications be dismissed. Neither applicant appeared to formally prove her case to the tribunal, and in the light of this lack of formal proof that a redundancy situation even existed in respect of this respondent, the tribunal has no alternative but to dismiss these applications.
Appearances:
Neither the applicants nor the respondents appeared. The applicants filed Originating Applications and these were considered pursuant to the provisions of Rule 9(3) of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 1996.
- The tribunal considered the terms of both the Originating Applications, and has found that there is insufficient evidence before it in the applications, to enable it to consider whether or not a redundancy situation even existed in respect of this respondent.
- As such, the tribunal considers that it has no alternative but to dismiss the applicants' Originating Applications.
