Morrison v Compass UK Ltd (Holiday Pay) [2003] NIIT 1812_02 (8 January 2003)
THE INDUSTRIAL TRIBUNALS
CASE REF: 1812/02
APPLICANT: Teresa Morrison
RESPONDENT: Compass UK Limited
DECISION
The unanimous decision of the Tribunal is that the application be dismissed and that the respondent's counter-claim be also dismissed.
Appearances:
The applicant did not appear either in person or through any representative.
The respondent did not appear either in person or through any representative.
SUMMARY REASONS
- The tribunal considered it appropriate to deal with the matter in the absence of both parties on consideration of the Originating Application and of the Notice of Appearance.
- Having considered these documents the tribunal was of the view that there was insufficient information to support the applicant's claim for holiday pay and insufficient evidence to support the respondent's counter-claim for overpayment. Accordingly both application and counter-claim fall to be dismissed.
