- Both parties failed to attend or to be represented at the time and place fixed for the hearing. Neither party made any representations in writing of the kind envisaged in rule 8(4) of the Industrial Tribunals Rules of Procedure 1996 and no party provided any written answer of the kind envisaged in rule 4(3) of those rules.
- This was a complaint of contravention of the Sex Discrimination (Northern Ireland) Order 1976 and/or of contravention of the Equal Treatment Directive 1976. Having considered the applicant's Originating Application and the notice of appearance the tribunal notes that, in proceedings for contravention of the Order or of the Directive, the onus of proof is on the applicant. The tribunal decided to dismiss the application.
