DECISION
The unanimous decision of the tribunal is that the contract of employment was tainted with illegality. Accordingly the tribunal dismisses the originating application.
APPEARANCES:

RESPONDENTS: Mr I Cooper appeared for both respondents.
(i) whether the contract of employment was tainted with illegality
(ii) whether the applicant was self employed and not entitled to claim unfair dismissal, and
(iii) whether there was a dismissal at all.
"However if the employee is involved in the illegality to such an extent as to be debarred from relying on the contract it is difficult to see why in law, reason or justice he should be able to claim any statutory right founded on the contract, see Leighton -v- Michael 1996 IRLR 67."
