In the absence of the parties, without explanation, the Tribunal decided to hear the matter.
(a) The applicant was employed as a joiner from 20 March 1999 to 28 September 2001. His weekly earnings were £243 gross £197.42 net.
(b) The applicant's Originating Application did not contain sufficient information to enable the Tribunal to quantify the applicant's claim for holiday pay.
(c) The Office of the Industrial Tribunals and the Fair Employment Tribunal received a letter from the Department of Employment & Learning dated 30 May 2002 in which it stated that the applicant's claim for an insolvency payment had been accepted and processed and he had been paid £592.14. It further stated that all claims made by the applicant had been processed for payment and that the Department had fulfilled its statutory obligations in respect of his claim for payment out of the National Insurance Fund.
A copy of the letter was sent to the applicant on 6 June 2002 for his immediate comments. To date no response has been received from the applicant.
(d) For the reasons stated above the applicant's claim is dismissed.
