As the claimant’s claim had been presented outside the statutory time limit, this Pre Hearing Review was arranged to determine whether it would be just and equitable, in all the circumstances of the case, for the Tribunal to consider the claimant’s claim of discrimination on the ground of religious belief despite the fact that it is out of time. Having considered the claimant’s evidence together with the documents to which the Tribunal was referred and the submissions, the Tribunal decided that it would not be just and equitable, in all the circumstances of the case, for the Tribunal to consider the claimant’s claim of discrimination on the ground of religious belief despite the fact that it was out of time. The claimant’s claim of unlawful discrimination on the ground of religious belief and or political opinion is therefore dismissed. Oral reasons for the decision were given at the Hearing. Mr Hamill confirmed that the respondent was not seeking any other order against the claimant.
